Below is a list of the items you will need to provide for your closing:

Deed. A duly executed deed in recordable form must be reviewed by our office prior to closing. Our office can prepare the deed for the fee of $125.00.

Mortgage loan account numbers. Many banks now require that you provide a loan number before the bank will supply payoff figures for the mortgage loans. Please print the “SELLER” (If you need Adobe Acrobat, download it here), forms and fax (along with copies of your most recent mortgage statements) to this office with the name(s) of the bank(s) which hold your mortgage(s) and the account number(s) as soon as possible.

Outstanding Mortgages on Your Property to Individuals. If you have given a mortgage to an individual (as opposed to a bank) you must obtain the discharge of mortgage to be recorded at closing.

Tax Bill. If you have received your tax bill for payment, please contact this office before paying it or submitting it to your Bank for payment. If you paid the tax bill, please bring to the closing a stamped receipt and inform our office prior to closing that the bill has been paid.

Final Water/Sewer: If you have public water or sewer you must contact the city/town water/sewer department and request a final reading. Our office will adjust water, sewer and electric charges at the closing if final readings are presented. If you are unable to provide us with final readings, estimated adjustments will be made based upon most recent bills which should be forwarded to this office prior to closing. The parties will then have to make final adjustments between themselves after closing. Please be aware that water and sewer charges (and in certain cities and towns, electric charges) are liens on the property.

Condominiums. Please note that the sale of a condominium unit requires a 6D Certificate or New Hampshire Certificate RSA C. 356-B which indicates that no common charges are due. This may be obtained from the Condominium Association.

If the condominium project is in Massachusetts and is not serviced by a Municipal sewer system, you will need a copy of the most recent annual inspection report for the septic system, showing that system is in compliance with the new D.E.P. Title V Regulations.

If you are selling a home in Massachusetts that is not serviced by a municipal sewer system, you will need a copy of the Certificate of Inspection from a qualified Systems Inspector, pursuant to D.E.P. Title V Regulations, which states that the septic system or cesspool did not fail inspection.

New Construction: For new construction, you will need to bring a Certificate of Occupancy to closing.

IRS Tax Information. The Seller’s social security number or tax identification number must be provided prior to closing.

Property Owned by a Corporation. If the property is in Massachusetts and the title to the is property is in the name of a corporation, you will need, in addition to all of the above, a corporate tax lien waiver from the Department of Corporations if the property represent all or substantially all of the corporation’s assets; if the sale does not represent all or substantially all of the corporation’s assets, appropriate language to that effect must be on the face of the deed. If the deed is not signed by the corporation’s president and treasurer, a clerk’s certificate of vote in recordable form will be necessary.

Power of Attorney. If you are unable to personally attend the closing, please contact this office to make arrangements for the preparation and/or review of the necessary documents.

At the closing, you will be required to bring the following items with you:
Smoke Detector Certificate of Compliance. In Massachusetts, a Smoke Detector Certificate of Compliance is also required and may be obtained from your local fire department.

Picture identification (e.g. Driver’s License, Passport).
